Licence Terms
Following a lengthy discussion on
Smart Groups, it struck me as a bit daft that folks have to buy a digital
product before they get to read the terms and conditions related to the product.
So I decided to post the licence
terms and conditions bound to my models so that you can see before you buy what
your hard earned cash will buy you (and what it does not buy you).
Here follows the copyright and fair
use policy of Wings of Horus kits.
"Dear Customer
Plainly speaking,
Every effort has been made to bring you a quality product.
You may print copies of this model for friends, but you may not give them the
electronic file. You may not charge a fee.
You may not decompile or redistribute this kit in any other form.
You may print a "reasonable" number for a
friend, or relative.
You may build as many replicas of the WINGS OF HORUS MODEL KIT as you wish for
personal use.
LEGALLY SPEAKING:
WINGS OF HORUS MODEL KIT MODEL KIT LICENSE:
1) GRANT OF LICENSE:
WINGS OF HORUS PAPER WARBIRDS (Hereafter WOH) grants you a single, non-exclusive
license to use the WINGS OF HORUS MODEL KIT name / serial number; provided you agree to abide by the
terms of this Agreement. Any number of users are authorized to use the WINGS OF HORUS MODEL KIT on one computer at a time (and not by more than one individual
via a network). (Contact the author for pricing for Network / Educational
licences: Bulk discounts apply).
2) OTHER RESTRICTIONS:
You acknowledge that you do not become the owner of the WINGS OF HORUS MODEL KIT
(Model plans, template, software programs and/or documentation). You agree not
to transfer, rent, lease, sub-license, reverse engineer, modify, translate, the
WINGS OF HORUS MODEL KIT file. You may not share the file. You may not
place the file on any peer to peer network system, nor any other system extant
or otherwise designed to disseminate electronic files.
3.
INDULGENCE:

You
may share or make gifts of "hard copy" in limited quantities, provided
that this and all other materials in the file remain unaltered, and that all
parts of the document are provided.

You
may use the MODEL KIT as a basis for a derived work for personal use.
4) NO WARRANTY:
While we have attempted to ensure the reliability and accuracy of the WINGS OF
HORUS MODEL KIT, It is not possible to
guarantee the models appearance under all circumstances, due to the differing
skill levels of model makers, at all times, with all hardware and software and
craft tool configurations , For more reliable colors and results, buy the ink
and tools from the suppliers recommended in the MODEL.
There are NO WARRANTIES expressed or implied, including but not limited to,
implied warranties of merchantability or fitness for a particular purpose, and
all such warranties are expressly and specifically disclaimed.
5) NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES:
WOH cannot assume any liability for damage that occurs because of ham fisted use
of craft knives, or accidental injury with superglue, whether or not in
accordance with the instructions or specifications. ie if you hack your finger
off, it's your fault not that of WOH.It is your responsibility to ensure your safety while using the WINGS OF HORUS
MODEL KIT. In no event shall WOH or its suppliers, if any, be responsible for
any special, incidental or consequential damages whatsoever (including, without
limitation, damages for lost profits, business interruption, loss of
information, or any other loss, including limbs or portions thereof) arising out
of the use or the inability to use this product, even if WOH has been advised of
the possibility of such damage. "

Question: Can I print a copy
for my nephew?

Answer: Yeah sure, print two
or three.

Question: Can I burn a CD and give
a copy to my mate?

Answer: No, but get them to email
me with your name and I'll give you both a discount on your next purchase.

Question: Can I send my
friend a copy by email?

Answer: No (but
I'll gladly send a model manually if you wish to purchase your friend a gift)

Question: Can I sell copies
of your model?

Answer: Only if you are an
appointed agent, for which you will earn a commission.

Question: Can I print a copy
for my nephew / son / friend?

Answer: Yeah sure, print two
or three, but you must print all the sheets every time.

Question: Can I print a copy
for my nephew/ son / friend / scout troop / history class?

Answer: ask me for a quote.

Question: Can I use your
design as a basis for a new model?

Answer: For personal use, you
sure can. You may scan the model, manipulate the model file directly or
repaint it provided that the model is only for your use. For commercial
use, you must obtain permission and pay me royalties on each kit sold.
And just to make it absolutely
clear.....

Question: May I upload a copy of your
work that has taken you months of design time and share it with thousands of
strangers who will not pay you a penny?

Answer: No of course not you idiot.
Sooner or later our technology will catch up with you, in which case we shall
use every legal avenue to recover our lost sales revenues and sue your sorry
butt into oblivion.
